The KSM trial issue… bring the 9/11 mastermind to new York city for a civilian trial… turned ugly for the President Obama yesterday.

His Attorney General, Eric Holder, was absolutely stumped by a question from Senator Lindsey Graham yesterday before the Senate Judiciary Committee.

Graham asked Holder quote: Can you give me a case in United States history where an enemy combatant caught on a battlefield was tried in a civilian court?

Holder stammered, stumped by a question even NPR said he should have known was coming. He had no answer, so Graham answered for him. He informed Holder the answer is no, there is no case.

The likes of KSM have always been tried in a military court.

So why is the Obama administration insisting KSM go before a civilian court in New York? There can be only one answer: a political calculation that such a trial is good for Obama. Or he thinks it will be.

I think he’s made a bad bet. This is going to end up being a huge embarrassment for Obama… unless he backs out of his decision and sends KSM back to GITMO for trial.
