Today, the President of the United States of America, while on an official trip to China, will sign an executive order directing the government not to waste money. He might as well order water to run up hill or command the earth to be flat. The federal government conceded last night that in the ten months of the Obama presidency, it has wasted NINETY-SIX BILLION TAXPAYER DOLLARS. No one can take the executive order he will sign seriously. The problem with government is that it is the negation of freedom. When it runs something like the Post Office or Amtrak, it does not need to reward investors or entice consumers. The trials of those who masterminded 9/11 in federal district court in NYC should have occurred here years ago. If the Bush administration had done that in 2004, when it captured these people, they’d have been tried, convicted, and executed by now. The law is clear: If you are accused of violating American law, you are to be tried in the judicial district in which the crime occurred. This is not political correctness or policy of the present Department of Justice (DoJ), it is required by the Constitution. Mayor Giuliani never complained when Tim McVeigh was tried in federal court in Denver. In the Zacharias Moussaoui case, the one the government assured us was the 20th 9/11 hijacker, Mayor Giuliani not only lauded the prosecution in federal district court in Alexandria, VA, he testified for the government at the trial. As well, DoJ prosecutors have never lost a terrorism case in a federal district court in modern times. The same cannot be said of military prosecutors at Gitmo. They tried two cases to near-completion. One was a guilty verdict, and then the court set the defendant free in Yemen because the evidence was weak and he had already served enough time in American jails . The other ended with a plea to a lower level crime, and the defendant–though labeled a murderer by the government–was set free in Australia.

This proposal by Sen. Chris Dodd (D-CN) is tweedle dee versus tweedle dum. It is true that the healthcare bill passed by the House authorizes U.S. Attorneys to seek jail terms for those who refuse to acquire, receive, or purchase health care. The bill authorizes the IRS to add to the tax bill of anyone so refusing a 2.5% surcharge on that person’s taxes. Whoever refuses to pay the surcharge could be indicted for tax evasion, and if convicted, be sentenced to five years in federal prison. That incarceration would cost the feds about $50,000 a year; far more than any health care insurance package.

Choosing between Cong. Barney Frank’s let-the-Federal-Reserve regulate all banks legislation and Sen. Chris Dodd’s let’s-establish-a-new-regulator legislation is really a pick-your-poison choice. Both proposals presume that the free market should not be free, both presume that bureaucrats and politicians should supersede the free choices of consumers and investors, and neither proposal finds any basis in the Constitution. The Frank proposal puts most regulatory power into the hands of the super-secretive Fed, whose ways are essentially unknown and unknowable, while the Dodd proposal puts all regulatory power into the hands of a new bureaucracy. The Dodd proposal (a copy of which has not yet been released) purports to strip the Federal Reserve of some regulatory authority that it already has. If this were to pass, it would be the first time since 1913, when the Monster from Jekyll Island was born, that the government has actually taken power away from it.
